terms and conditions
Last updated: 13 October 2026
These Terms and Conditions ("Terms") govern your use of the tendTwo mobile application (the "App"), the website at tendtwo.com.au (the "Website"), and any related products and services we provide (together, the "Service"). The Service is operated by Nicola Ferendinos, a sole trader based in New South Wales, Australia. In these Terms, "tendTwo", "we", "us" and "our" refer to Nicola Ferendinos as the operator of the Service.
By creating an account, or by accessing or using the Service, you agree to be bound by these Terms. If you don't agree, you must not access or use the Service. These Terms form a binding agreement between you and tendTwo even though they're accepted electronically and not physically signed.
related documents and order of precedence
These Terms are the master agreement between you and tendTwo. These documents also apply to your use of the Service:
- our End-User Licence Agreement (EULA), which governs the software licence for the App; and
- our Privacy Policy, which explains how we collect, use, share and protect your personal information, including what we send to our AI provider.
If these documents are inconsistent, these Terms prevail over the EULA. The Privacy Policy governs how we handle personal information and should be read alongside both. A breach of the EULA is also a breach of these Terms.
eligibility and your account
You must be at least 18 years old to use the Service. By using it, you confirm that you are, and that the information you give us is accurate. tendTwo isn't for children or teenagers, and we don't knowingly allow anyone under 18 to hold an account.
You're responsible for keeping your sign-in secure and for all activity under your account. Tell us straight away at hello@tendtwo.com.au if you think someone has used your account without permission.
While tendTwo is in early access, accounts may be limited to people we've invited, and we may decide who to invite.
We may suspend or close your account if we reasonably decide that you've breached these Terms or the EULA, or that your use of the Service is harmful to another person, to the Service or to tendTwo. You can delete your own account at any time: see our delete account page.
your household
tendTwo is built around a household of two people. Each person can belong to one household at a time. Please keep the following in mind.
- Invite codes. You join a household with a one-time code from the person who set it up. Codes expire after 7 days. Only share your code with the person you mean to invite: anyone who uses it joins your home and can see what's in it.
- Equal members. Both members of a household can see and change shared tasks, routines and other household content. Neither can remove the other, but either can leave.
- What's shared. Most of what you add is visible to your partner. Private spaces and some other items are hidden in the app but not locked away from your partner. Our Privacy Policy (section 6) explains exactly what that means.
- What you share about others is your responsibility. You're responsible for what you add about your partner, your household and other people, such as helpers and household contacts. Only add information you're entitled to share, and keep details about children to what's needed to run your home.
- Leaving. If you leave a household, or delete your account while your partner stays, your private spaces and private items go with you. Things you shared stay with the household and your partner.
tendTwo is not a party to your relationship or your household arrangements. Subject to the "Australian Consumer Law" section below, we aren't responsible for disagreements between household members, or for how another member uses the Service. This doesn't apply to the extent any loss is caused by our own negligence, wilful misconduct, fraud or breach of these Terms.
free during early access
tendTwo is free to use during early access. There's nothing to buy and no subscription. If we introduce paid features in the future, we'll tell you before anything changes, and you'll never be charged without choosing to buy. Any purchase would be made through the Apple App Store or Google Play and handled under their terms and payment systems. We'd set out the terms for any paid feature at that time.
Because tendTwo is in early access, features may change, be added or be removed as we learn what helps. We'll give reasonable notice of changes that materially reduce what the Service does, where practicable.
AI suggestions
tendTwo's chat and AI-written date ideas are optional. Each person chooses whether to turn chat on, and can turn it off again at any time. When it's on, it's powered by a third-party AI model, as explained in our Privacy Policy (section 5). AI-generated content is produced automatically and:
- can be wrong, incomplete or out of date, and can misunderstand what you meant (for example by adding the wrong task, date or person);
- isn't professional advice of any kind, whether medical, legal, financial or safety; and
- isn't reviewed by a person before you see it.
Please check what tendTwo adds or suggests. You're responsible for what you act on. Subject to the "Australian Consumer Law" section below, we aren't liable for decisions you make, or things you do or don't do, because of an AI suggestion.
You must not use the chat to try to produce unlawful, harmful or abusive content, or to get around the limits of the Service.
cycle awareness is not medical advice
The optional cycle feature estimates your phases from the dates you enter. It exists to help you and your partner be a little more mindful of each other.
- It is not medical advice, and it doesn't diagnose, treat or monitor any condition.
- It is not contraception, and you must not use it to prevent or plan a pregnancy.
- Its forecasts are estimates and will often be wrong, especially if your cycle varies.
If you have any questions or concerns about your health, talk to a doctor or other qualified health professional.
nudges and reminders are best-effort
tendTwo sends reminders, nudges, time-block check-ins and summaries to help you keep track of things. Their delivery depends on things outside our control: your phone's settings, battery and focus modes, your network, and Apple's and Google's notification services. They may arrive late, more than once, or not at all.
Don't rely on tendTwo for anything time-critical or safety-critical, such as medication, care of a person or animal, legal or payment deadlines, or appointments you can't miss. Weather information comes from a third party and may be inaccurate.
acceptable use
You must not, in connection with the Service:
- use tendTwo to monitor, track, harass, intimidate or control another person, including your partner;
- create, store or share child sexual abuse or exploitation material, or use the Service in any way that sexualises, exploits or endangers a child;
- add another person's personal information that you're not entitled to share, or use someone else's account;
- use the Service for anything unlawful, or to store or share content that's unlawful or that you don't have the right to share;
- get around, or try to get around, any access limit, invitation requirement, suspension or security measure;
- access the Service with bots, scripts or other automated means, or scrape or harvest data from it;
- upload viruses or malicious code, or interfere with, disrupt or place undue load on the Service or its infrastructure;
- reverse engineer the App except as the law permits (see the EULA); or
- infringe anyone's intellectual property, privacy or other rights.
your content
We don't own the data, information or material ("Content") you add to the Service, such as your tasks, routines, notes and chat messages. You're responsible for your Content, including its accuracy and lawfulness, and for making sure you have the right to add it.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display your Content solely as needed to operate and provide the Service to you and your household. That includes sending it to our service providers as described in our Privacy Policy. The licence ends when your Content is deleted from the Service, except to the extent we must keep it by law. We don't use your Content for advertising, and we don't use it to train AI models.
intellectual property
The Service itself is owned by or licensed to tendTwo and protected by intellectual property laws. That includes the tendTwo name, logo, App and Website, and all software, design and content we create. These Terms don't give you any rights in it beyond the limited right to use the Service and the licence in the EULA.
If you believe something on the Service infringes your copyright or other intellectual property rights, email hello@tendtwo.com.au with:
- the work you say is infringed;
- where the content appears;
- your contact details; and
- a good-faith statement that the use isn't authorised.
We'll review it and act on it.
backups
Keep your own copy of anything important. We don't keep backups of household data, so once content is deleted (by you or by your partner) it's gone for good and can't be recovered. Subject to the "Australian Consumer Law" section below, we're not liable for any loss of Content.
third-party services
The Service relies on third parties we don't control, including Apple, Google, our AI provider Anthropic, and our weather provider. Weather data is provided by Open-Meteo.com under the CC BY 4.0 licence. The Service may also link to third-party websites. We don't endorse and aren't responsible for third-party content, products or services, and you use them at your own risk and under their own terms.
Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) ("ACL"), or any other law that can't lawfully be excluded, restricted or modified. Every disclaimer, exclusion, limitation and release in these Terms is subject to this section and applies only to the maximum extent permitted by law.
Where legislation permits us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.
disclaimers
Subject to the "Australian Consumer Law" section above and to the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We make no representation or warranty that:
- the Service will be uninterrupted, secure, error-free or free of harmful components;
- any content on the Service is accurate, whether it's AI-generated, comes from a third party such as a weather forecast, or is created by a household member; or
- using tendTwo will produce any particular result for your household or your relationship.
limitation of liability
Subject to the "Australian Consumer Law" section above and to the maximum extent permitted by law:
- tendTwo and its officers, employees and agents are not liable for any indirect, incidental, special or consequential loss or damage, loss of data, loss of opportunity or loss of goodwill arising out of or in connection with the Service or these Terms, however caused, even if we've been told that loss is possible; and
- our total aggregate liability arising out of or in connection with the Service or these Terms is limited to A$100, a reasonable amount given the Service is provided free of charge.
The cap and the exclusion of consequential loss above do not apply to:
- liability for death or personal injury caused by our negligence;
- liability for fraud or wilful misconduct; or
- any liability that can't be excluded or limited by law, including under the ACL.
indemnity
To the extent permitted by law, you agree to indemnify tendTwo and its officers, employees and agents against loss, damage, liability and reasonable costs (including reasonable legal costs) arising from third-party claims, to the extent caused by any of the following:
- your breach of these Terms or the EULA;
- your Content, including information you add about other people; or
- your unlawful conduct.
Your liability under this indemnity is reduced to the extent our own acts or omissions contributed to the loss.
termination
You may stop using the Service and delete your account at any time. See our delete account page.
We may suspend or end your access to the Service, or any part of it, in any of these cases:
- you breach these Terms or the EULA;
- the law requires it; or
- we discontinue the Service.
Where practicable, we'll give you notice first, and if we discontinue the Service we'll give you reasonable time to save anything you need. We may act immediately where necessary to protect people, comply with the law, or deal with a serious breach.
Sections of these Terms that by their nature should survive termination do survive it. They include "Australian Consumer Law", "Disclaimers", "Limitation of liability", "Indemnity" and "Governing law and disputes", along with any accrued rights and obligations.
governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales, and courts entitled to hear appeals from them, have non-exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service. Nothing in this section limits any right you have to bring proceedings under applicable consumer protection law.
If you have a problem or dispute with us, please talk to us first. Email hello@tendtwo.com.au with a description of the issue, and we'll try in good faith to resolve it with you, normally within 30 days. Each of us agrees to try this informal resolution before starting court proceedings, except where urgent relief is needed.
changes to these terms
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date at the top of this page.
For material changes, we'll give you at least 30 days' notice through the App or by email. Material changes include changes to how we handle your data, to our service providers, to pricing or to liability.
If you keep using the Service after updated Terms take effect, you accept them. If you don't agree to updated Terms, stop using the Service; you can delete your account.
general
- Severability. If any provision of these Terms is found invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the rest will continue in full force.
- Waiver. If we don't enforce a provision, that isn't a waiver of it.
- Assignment. You may not assign your rights under these Terms without our consent. We may assign ours as part of a genuine restructure, merger or sale of the business, provided your rights aren't materially reduced.
